Current migratory crises pose a fundamental challenge to the external and internal borders of Europe. Will it be possible to uphold the human rights of the refugees and the principle of sovereign territoriality at the same time? This talk explores that question by excavating a little known debate between two 20th century German political thinkers—Hannah Arendt and Carl Schmitt—on the topics of territory and law. Arendt’s critique of Schmitt opens a novel route for rethinking territories as non-exclusive and non-sovereign, and thus conceptually compatible with the cosmopolitan aspiration to open borders.
