U.S. Tax Information

All international students and scholars are required to file tax forms with the United States tax department (Internal Revenue Service, or IRS) and possibly with the New York State tax department if they were present in the United States during the previous calendar year. For example, if you resided in the United States as an international student or scholar between January 1 and December 31, 2018, you would need to file tax forms in spring 2019 (the annual filing deadline is April 15). If you arrived in the United States in 2019, you would file forms in spring 2020 for the 2019 calendar year.

International visitors must file tax forms whether or not income was earned while they were in the United States. 

U.S. Tax Information

If you were in the United States but did not earn any money, you need to file form 8843 only. 

Individuals who earned income should file form 1040NR or 1040NR/EZ. Earned income would be any monies received in the United States that are not considered qualified expenses as defined by the IRS. More information about international tax responsibilities and eligible deductions can be found here.

You must have a Social Security number or Tax ID number to file 1040NR/1040 NR-EZ tax forms in the United States.

U.S. tax law is extremely complex and each foreign national's situation varies. Bard staff are not qualified to answer questions regarding individual tax liabilities, but can refer you to resources to help you with taxes in the U.S.  It is the responsibility of each international visitor to understand their own tax situation.

NEW YORK STATE INCOME TAXES
If you worked in New York State, you might also have to file New York State income tax forms.  If you filed form 8843 ONLY, you do NOT have to file New York state income tax forms.  You can also download New York state tax forms from the following website: www.tax.ny.gov

Taxation of Scholarships, Fellowships, and Stipends

A scholarship/fellowship payment is generally not taxable income provided it meets the criteria of use for "qualified expenses."

Qualified expenses are defined by the Internal Revenue Service (IRS) and include tuition and required fees, and/or for books, supplies, and equipment required of all students in the course. These payments do not need to be reported to the IRS by the student or the College.

A scholarship/fellowship used for expenses other than qualified expenses is taxable income. Taxable scholarships are generally referred to as stipends and are payments for which no services are rendered or required. Examples of stipends are payments that can be used for living and incidental expenses such as room and board, travel, nonrequired books and personal computers, etc. 

A stipend paid to a nonresident alien with an F1 or J1 visa is subject to U.S. income tax withholding at a rate of 14 percent unless tax treaty relief is available. Currently, state taxes are not required to be withheld by the College even though the payments may be taxable in the state. However, this is subject to changes in state legislation. A taxable scholarship/fellowship is not subject to FICA withholding since the payment is not for services.

Students from countries that have a tax treaty with the United States that includes a scholarship article may claim exemption or a reduction of the 14 percent withholding if the payment meets the requirements of the treaty. The student must, however, complete the required forms at the College’s Payroll Office.

The College reports stipend payments and the amount of federal tax withheld, if any, on Form 1042-S to the student and to the IRS. Students are responsible for reporting these payments and remitting any tax due with their personal income tax return at the end of the year on form 1040NR or 1040NR-EZ and the corresponding state forms.

The NonResident Tax Help Group (NoRTH) & Bard College International Tax Clinic

The NonResident Tax Help Group (NoRTH) provides free tax services to individuals with a school, nonprofit, or government email address. If you have an email that ends in .edu, .org, or .gov., you are eligible to become a member and utilize NoRTH free services. Other organization email addresses, or those from organizations that are based outside of the U.S., may have a different ending, but can also meet our criteria. If you have any questions about membership, please feel free to contact NoRTH at [email protected].

NoRTH provides free tax software, tools, guides, and video demos that are available on demand 24/7. They also provide individual support through email, as well as through in-person tax clinics, remote tax clinics, and remote office hours sessions. Appointments for all events are available from now through mid-April. Please note that NoRTH does not prepare your tax return for you; they provide tax guides and assistance to help you file your own taxes.
